INSURANCE ALERT

Does your boat or yacht policy cover you if you sign an agreement with a marina for moorage or marine services? Will your insurance company defend you if a marina sues you for damage to the marina or injury to a third person? Many marine policies exclude coverage if you sign an agreement assuming liability or waiving subrogation rights (the right of your insurance company to recover from the marina if the insurance company pays your claim and the marina is at fault.) There seems to be an increasing practice by marinas in Washington to require boaters, as a condition of doing business, to sign agreements shifting liability to the boater for damage to the boat or damage/injury to third parties. We have also heard of instances where this practice is occurring in British Columbia. We urge you to contact your insurance company or broker to make sure you are covered for marina agreements you have signed or intend to sign.
